Collective Labor Contracts

Collective work contract: A written agreement according to which the terms of work are organized between the employer or union of the employers on the one hand, and a group of workers or the union on the other.

The Jordanian Labour Law No. (8) of 1996, as amends in Chapter (VI) stipulates the organization of the collective labour contract;

Where the collective work contract is conducted from at least 3 copies, and each party keeps a copy of it, and the third copy is deposited with the ministry for registration in a special registry. The collective work contract shall be binding from the date specified in it, and in the event that the date is not set, it shall be from the date of its registration with the Ministry, provided that these contracts are published in the Official Gazette and announced on a special board at the workplace.

The collective work contract is conducted for a definite or indefinite period. If it is contracted for a definite period, it may not exceed two years, and if it is conducted for an indefinite period, and at least two years have passed since its implementation,

Any of the parties to the contract may take the following:

Requesting the terminate of the contract by virtue of a notice notified to the other party at least one month prior to the date of termination.
Requesting the amendment of the contract in whole or in part by virtue of a notice notified to the other party, provided that this amendment takes place within a period of one month from the date of notification, and the notifier must immediately send a copy of it to the Ministry.

The collective work contract ends with the expiration of its valid term or termination by one of the parties in accordance with the provisions of Article (40) of the Labour Law. If there are negotiations to renew, extend or modify its term, its effect remains valid throughout the negotiations for a period not exceeding six months. If the negotiations do not over in agreement during this period, the contract is considered terminated.
